Expedited Arbitration and Emergency Arbitration 

Expedited arbitration is an option for cases that need to be resolved relatively quickly. At Miles, we offer expedited arbitration for a flat fee of $5,000 per party for claims of $75,000 and less. 

With expedited arbitration, we appoint the arbitrator and there is minimal to no discovery; a preliminary conference is scheduled to discuss any preliminary issues and set a final hearing date. Expedited arbitrations are limited to one day for a final hearing — should the arbitrator decide that more time is needed, the parties will be billed accordingly. An expedited arbitration is usually resolved within 90 days.  

 We also offer emergency arbitration with the same fee schedule.  

Fees for Expedited and Emergency Arbitrations

The total costs of the proceedings encompass administrative fee and arbitrators’ fee. Because expedited and emergency arbitrations are expected to conclude within one day, if the hearing exceeds the given time frame, Miles shall charge each party a minimum of 4 hours of additional time at the arbitrator’s hourly rate. 

Expedited and Emergency Arbitration Cancellation Policy
If an Expedited/Emergency Arbitration Hearing scheduled on the merits of the case cancels after the preliminary conference, the expedited/emergency arbitration fee is refundable minus (i) the commencement and administrative fee of $250 per party; and (ii) the time that the Arbitrator has incurred for document review and the preliminary conference to be billed at the arbitrator’s hourly rate. 

However, if an Expedited/Emergency Arbitration Hearing scheduled on the merits of the case cancels within 3 business days of the hearing, the expedited/emergency arbitration fee is refundable minus (i) the commencement and administrative fee of $250 per party; (ii) the time that the arbitrator has incurred for document review and the preliminary conference; and (iii) 4 hours of the arbitrator’s hourly rate.
