Robert Cohen

Judge Cunningham has been a full-time mediator and arbitrator since 2022, handling a variety of cases including contract disputes, personal injury/automotive, uninsured motorist claims, employment, civil rights, and will contests/trust disputes. He was the longest serving judge in the State of Missouri, with more than 41 years of service at the time of retirement. Prior to joining the Bench, Judge Cohen was engaged in the private practice of law with the firm of Thomas, Busse, Weiss, Cullen and Godfrey, representing both plaintiffs and defendants. Judge Cohen was elected magistrate judge, Second District, St. Louis County in 1974 and he was reelected in 1978. Judge Cohen served as an Associate Circuit Judge, Division 32, until 1994, when he was appointed Circuit Judge, Division One by Governor Mel Carnahan. In the years 1998 through 2000, Judge Cohen was the Presiding Judge of the Circuit Court of St. Louis County. In 1985, Judge Cohen was honored to serve as the President of the St. Louis County Bar Association. Judge Cohen’s articles have been published in the Journal of the Missouri Bar, the St. Louis Bar Journal, the Missouri Conservationist, and the St. Louis Countian. He has authored chapters in Missouri Bar Continuing Legal Education desk books. Judge Cohen was a principal author of Missouri’s first mental health civil commitment statutes. He served on the Missouri Supreme Court ad hoc Court Security Committee, as well as the Missouri Bar Judicial Administration Legislative Review Committee. Judge Cohen received the Dudley C. Dunlop Distinguished Service Award in 2016 from the St. Louis County Bar Association.

St. Louis Rates 4hr Min.
2 Party Case: $225 per party; per hour
3 Party Case: $150 per party; per hour
4 Party Case: $112.50 per party; per hour
5+ Party Case: Flat Rate Available Upon Request
Arbitration Hourly Rate: $450

Travel time and expenses, including meals and lodging, billed separately and split equally among the parties at the Neutral's hourly rate.

Mediation /Arbitration Admin Fees
St. Louis Mediation Admin Fee - $250 per party
Arbitration Commencement And Administration Fee: $1500 per party

MEDIATION CANCELLATION POLICY

Mediations cancelled within 10 days of the mediation will be charged a cancellation fee of $500. However, mediations cancelled, rescheduled or settled within 24 hours of the mediation will be charged 4 hrs. of the Neutral's hourly rate . Cancellation fees shall be sent to the cancelling party unless otherwise agreed to by the parties.

ARBITRATION FEE PAYMENT POLICY

Arbitration Commencement and Administrative Fee is $1500.00 per party, per arbitrator. At the commencement of arbitration, each party will be invoiced $1500.00. This fee is refundable minus $500.00 per party until the initial case management order has been issued. All arbitration related invoices are due upon receipt.

ARBITRATION CANCELLATION POLICY

If a single-day Arbitration Hearing scheduled on the merits of the case cancels or reschedules within 15 business days of the hearing, the parties will be charged 4 hours of the Arbitrator’s hourly rate. However, if the single-day Arbitration Hearing cancels or reschedules within 2 business days of the hearing, the parties will be charged 8 hours of the Arbitrator’s hourly rate.

If a multi-day Arbitration Hearing scheduled on the merits of the case cancels or reschedules within 28 business days of the hearing, the parties will be charged 4 hours of the Arbitrator's hourly rate for each day reserved for the hearing. However, if the multi-day Arbitration Hearing cancels or reschedules within 7 business days of the hearing, the parties will be charged 8 hours of the Arbitrator's hourly rate for each day reserved for the hearing.

Issuance of the Final Arbitration Order/Award

Arbitration Awards/Orders will not be issued to either party until Miles has received full payment for all fees and expenses associated with the arbitration.
