5 Questions to Ask Before You Choose an Arbitrator

You’re representing a client in a case that is going to arbitration. You may already have a potential arbitrator (or more than one) in mind, but before you move forward with scheduling the arbitration, it’s smart to consider the following five questions:
How large is the arbitration panel?
Even if you have an idea of who you want to hire as an arbitrator, you may not be able to retain that person. That arbitrator may be conflicted out, or the other party may not agree to your choice. Choose a firm with a sizeable arbitration panel firm to give you, and the other party, plenty of options to select from.
How diverse is the arbitration panel?
A more diverse panel gives you, and your client, more options. It also increases the likelihood that you’ll find an arbitrator that meets your, and your client’s, specific wants and needs.
How much information does the arbitrator provide about pricing?
While arbitration is typically less expensive than traditional litigation, it does cost money, and those costs can add up. Look for an arbitration firm that offers transparency in terms of pricing and fees.
How quickly can you schedule the arbitration?
You’ll want to check the availability of the potential arbitrator(s) and see how early you can schedule the arbitration if time is of the essence. You may also want to consider expedited arbitration, which typically takes much less time than traditional arbitration.
Does the arbitration firm have its own arbitration rules, documents, and other resources to make arbitration easy for you?
