Miles’ Neutrals Present at the 13th Annual AtlAS Conference

Jennifer GrippaJennifer Grippa will participate in Tertulia Panel 2A: “Getting to the Evidentiary Hearing in an Arbitration,” scheduled for Monday, Oct. 7, at 4:50 p.m. at the McGuireWoods LLP office. This session will delve into the arbitral process, covering critical topics such as case schedule preparation, document production, information exchange procedures, motion practice, and obtaining testimony from non-party witnesses. Jennifer will be joined by Christopher Smith (Smith, Gambrell & Russell LLP – Atlanta; co-chair of the Conference Planning Committee; AtlAS secretary; ICC YAAF alum) as the session chair, and Brent Clinkscale (Clinkscale Global – Greenville; member of the Conference Advisory Committee; ex officio member of the AtlAS Executive Committee).

 

Tamika NewsonTamika Newson will moderate Panel 1: “The Force Majeure Defense Today: Considerations for the Construction Sector and Other Industries” on Wednesday, Oct. 9, at 9:40 a.m. This panel will explore the evolution of the force majeure defense and its implications for various industries, particularly construction. Key discussion points will include the origin of the force majeure defense, how to draft effective force majeure clauses, and real-world examples of force majeure events. The panel will also examine how force majeure issues are treated in jurisdictions outside the United States. Joining Tamika on the panel are Rebecca Velez (HKA – Washington, D.C.), James Derrick (Womble Bond Dickinson (US) LLP – Charlotte), Jessica Sabbath (McDermott Will & Emery LLP – Atlanta), and Peter J. Pettibone (Pettibone International ADR – New York).

 

David GalloDavid Gallo will moderate Panel 2: “Regulatory Changes Mid-Stream: What’s a Business to Do?” on Wednesday, Oct. 9, at 11:10 a.m. This panel will address the challenges that arise when regulatory changes disrupt a project midstream, exploring effective strategies for businesses to adapt. Discussion topics will include the types of legal changes that may occur, implications for dispute resolution, availability of remedies, and key distinctions between civil law and common law systems. The panel will also consider recent developments, including the emergence of ESG considerations and lessons learned from COVID-19. Joining David on the panel are Scott Cahalan (Smith, Gambrell & Russell LLP – Atlanta), Florian Mohs (Pestalozzi – Zurich), Lance Lee (Arnall Golden Gregory LLP – Atlanta), and James Boykin (Hughes Hubbard & Reed LLP – Washington, D.C.).

 

Both Tamika and David’s sessions will take place at Womble Bond Dickinson (US) LLP.
